Photograph Agreement for Research or Publication

University of Florida Herbarium (FLAS)

The undersigned agrees to the following conditions regarding images taken of/from the collections of the University of Florida Herbarium, a division of the Department of Natural History of the Florida Museum of Natural History.

• Research is defined as use of the image for study, teaching, or comparative purposes. Publication is defined as use of the images in exhibits, in popular or scholarly publications (including brochures) and presentation on the Internet.
• The photographer agrees to joint right-of-use and copyright with the University of Florida Herbarium for all images of/from the collections of the University of Florida Herbarium. All publishers must be made aware that the photograph is used by permission and that the University of Florida Herbarium maintains joint copyright.
• Any image taken of/from the collections of the University of Florida Herbarium will be credited as being of/from those collections with the date the image was taken. The credit shall contain the University of Florida Herbarium specimen accession number (if the specimen has an accession number) and shall read similar to: "Image of specimen from University of Florida Herbarium, FLAS ######, Florida Museum of Natural History."
• If images are to be used on the Internet, the photographer agrees to obtain special permission to post the images and, if permission is granted, the photographer will provide the URL of the site where the images are posted.
• The photographer agrees not to provide exact localities of rare and endangered species on the Internet. This may require the photographer to obscure label portions of specimen images. The University of Florida Herbarium will advise the photographer on these criteria.
• The photographer agrees to provide to the University of Florida Herbarium a copy of each digital photograph in the highest digital format and resolution taken.
• The University of Florida Herbarium agrees to credit the photographer when/if using the photographs on our web site or in publications.
• The University of Florida Herbarium agrees to coordinate usage of the photographs on our web site or in publications for a reasonable period so that the photographer may publish their research.
• The photographer agrees to provide (gratis) to the University of Florida Herbarium one copy of all publications in which images appear. This includes subsequent editions or additional language editions.
• No parties shall use the images created in any way, except in the manner described above, without explicit written permission of the University of Florida Herbarium, Florida Museum of Natural History.
